I have a friend who is living temporarily in Greece, but has debts in Belgium. She also has a house in Belgium with several liens upon it. She has insufficient income to pay off the loan to the Belgian bank. Where does she file for bankruptcy?
EU member states all observe each other’s insolvency laws under something called ‘Cross Border Cooperation’. If she was seeking the protection of bankruptcy, she would need to file for this in the country where her ‘Centre of Main Interests’ was and it sounds very much like it is in Belgium. We are not familiar with the insolvency laws in Belgium, but hopefully they are not as severe as Germany’s. Indeed, we have many Germans relocating to England to take advantage of the more lenient insolvency laws.
