Name Printed Newspaper Bankrupt- Is my name printed in the Newspaper when Bankrupt? Is often a question we receive: In short…No, (Unless your bankruptcy is a ‘public interest’ bankruptcy in which case yes) your name will not be printed in the newspaper. it will not happen as the laws changed back in 2009 to bring everything in line with the Enterprise Act.

The only time a name is printed in a newspaper and published now is if, for example, a trader had many local creditors (suppliers, etc.) and the Official Receiver thought it might be in the best interests of the community to publish the information in a local newspaper. But for everyday bankruptcies this will not happen.

Names are published in the Government Gazette, but the only people that view this information are professional bodies (banks, solicitors, etc.) and it is most unlikely that anyone from your local community would know. Ever since the introduction of the Enterprise Act 2002, conditions surrounding bankruptcy have been greatly toned down and this has been further enhanced with the introduction of online applications.

It is now no longer necessary to go to court for bankruptcy, the role of the Judge having been assumed by the so-called Adjudicator in Bankruptcy. The Adjudicator assesses the case for validity then passes it on electronically to the Official Receiver, who carries out his role as was always the case.

People attempting their own bankruptcies need to take care when completing the Income and Expenditure, as all manner of non-claimable items have been included.

The reason for this is that it is very much in the Official Receiver’s best interests to place you in an Income Payments Agreement (IPA) for three years to offset costs.
